HomeProFax Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Repdigi LLC, a North Carolina limited liability company doing business as HomeProFax (“HomeProFax,” “we,” “us”). They govern your use of homeprofax.com and related services (the “Service”). Please also read our Privacy Policy, which explains how we handle personal information.

Agreement

By using the Service you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old and able to form a binding contract. If you use the Service for a business, you agree to these Terms for that business.

What HomeProFax is

HomeProFax organizes public records about contractors (such as license status, board discipline, building permits and business registrations) into reports and a HomeProFax score. It also offers Get matched, which lets homeowners choose contractors to contact them about a project. HomeProFax does not perform construction work. We are not a contractor, broker, agent or party to any agreement between you and a contractor. We do not employ, supervise or guarantee any contractor.

Public-record information and scores

Reports come from public sources and third parties. Records can be outdated, incomplete or matched to the wrong business. The HomeProFax score sums public-record factors (license status, discipline, permit history and reviews) using the formula on our Methodology page. It is not an endorsement, a rating of workmanship, or a guarantee of price, timeliness, insurance or quality. Always verify license status, insurance and permits directly with the issuing agency, and get written quotes, before you hire. Results in Get matched are sorted by score. Ties are ordered by verification status, location, permit history and a daily rotation. No contractor can pay to change its score.

Not a consumer report

HomeProFax is not a “consumer reporting agency” under the Fair Credit Reporting Act (FCRA), and the Service does not provide “consumer reports.” You may not use the Service to decide eligibility for credit, insurance, employment, housing or tenant screening, or for any other purpose covered by the FCRA or similar state laws.

Get matched

Get matched is free for homeowners. When you submit a request:

Contractors who receive a request may use it only to respond to that homeowner about that project. They may not resell, share or add it to marketing lists. They must honor opt-out requests promptly.

Calls and texts

By checking the consent box on the contact step and then confirming the contractors you chose, you agree that HomeProFax and those contractors may contact you about your project by email, phone call or text message at the details you gave, including calls and texts that may use automated technology. Consent is not a condition of any purchase. Message and data rates may apply. You can opt out at any time: reply STOP to a text, tell the caller to stop, or contact support@homeprofax.com. Reply HELP for help. Carriers are not liable for delayed or undelivered messages. If you give a phone number that is not yours, you agree to tell us right away.

Contractors: profiles, claims and corrections

Contractor profiles are created from public records whether or not the contractor uses the Service. A contractor (or an authorized representative) may claim a profile for free. Claims require email confirmation and admin approval. A Verified badge is issued only after checks pass and an admin approves. By claiming, you confirm that you are authorized to act for the business and that what you submit is true. You must keep it accurate. You may not claim a profile you do not represent.

Anyone may request a correction. We check requests against the original source and may update, annotate or decline them. Claiming or paying does not change the public-record factors in a score. We may remove or suspend a claim, badge or profile update that we believe is inaccurate, misleading or abusive.

Reviews and content you submit

You are responsible for content you submit, such as reviews, corrections, photos and descriptions. It must be truthful and based on your own experience. It must not be defamatory, harassing, discriminatory or infringing, and must not contain other people’s private information. You grant HomeProFax a worldwide, non-exclusive, royalty-free license to host, display, adapt and distribute that content in connection with the Service. We may moderate, annotate or remove content at our discretion, including under our review and correction policies.

Most of the Service is free. Homeowners never pay to use Get matched. HomeProFax offers a paid Verified Pro subscription for contractors with an approved claim, at $49 per month, billed by Repdigi LLC d/b/a HomeProFax through Authorize.net. Card details are entered on Authorize.net’s hosted payment page and are not stored by HomeProFax. Prices, features and billing terms are shown before you buy and are part of these Terms.

14-day refund window. If you are not satisfied with a paid product, you may request a full refund within 14 days of your first purchase of that product by emailing support@homeprofax.com or calling (866) 776-3291. After 14 days, payments are non-refundable except where the law requires otherwise. Subscriptions renew automatically until you cancel. You can cancel at any time to stop future charges, and access continues through the end of the paid period. Paid products never change a contractor’s HomeProFax score. Any paid placement will be clearly labeled.

Our content and intellectual property

The Service, including its design, text, scores, compilations, software, logos, the HomeProFax name and the Clyde mascot, is owned by Repdigi LLC or its licensors and protected by law. Underlying government records remain public. Our selection, arrangement and scoring of them are ours. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial research about contractors, and for contractors to manage their own profile. You may share links to reports.

Third-party links and services

The Service links to government sites, contractor websites and other third parties. It also relies on providers such as Cloudflare, Resend and Google. We are not responsible for third-party sites or services, or for their content or practices.

Disclaimers

THE SERVICE AND ALL INFORMATION ON IT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. HOMEPROFAX DOES NOT WARRANT ANY CONTRACTOR’S LICENSE, INSURANCE, BOND, WORKMANSHIP, PRICING OR CONDUCT, AND IS NOT RESPONSIBLE FOR ANY CONTRACTOR’S ACTS OR OMISSIONS.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HOMEPROFAX AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR ANY DEALINGS WITH A CONTRACTOR. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow these limits, so they may not apply to you.

Indemnity

You agree to defend, indemnify and hold harmless Repdigi LLC and its members, managers, employees and agents from claims, losses and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of the Service, your violation of these Terms or the law, or, if you are a contractor, your handling of homeowner requests.

Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you and HomeProFax consent to their jurisdiction. Either party may bring a qualifying claim in small-claims court. Before filing a claim, please contact us at support@homeprofax.com so we can try to resolve it informally within 30 days.

Suspension and termination

We may suspend or end your access to the Service, remove content or decline requests at any time if we believe you have violated these Terms or the law, or to protect users and the Service. Sections that by their nature should survive termination will survive.

General terms

We may change these Terms by posting an updated version with a new “Last updated” date. Material changes apply going forward. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets. These Terms and the Privacy Policy are the entire agreement between you and HomeProFax about the Service.
